Establishing Liability for Dangerous Dog Attacks in Florida

Florida code §767.13 provides that if a dog is deemed dangerous and attacks a victim or another domesticated animal despite a lack of provocation, the state of Florida may find the dog’s owner in violation of Florida’s criminal laws. In this event, Florida holds the dog owner accountable for the following:

  1. All costs associated with the department’s investigation of the matter; and
  2. All boarding fees and related fees associated with temporarily housing the dog in a safe location while awaiting a hearing.

In the event that the dog owner files an appeal within the allotted time period, the dog cannot be euthanized while the appeal is pending unless two veterinarians declare that euthanasia will alleviate the dog’s unnecessary suffering.
