Elements of Declaring Dangerous Dogs in Florida

Florida statute 767.13 Sec. 4-34 provides that a dog is considered dangerous when the following is true:

  • No person may allow an animal in their possession to injure, attack, or bite a person, domesticated animal, or cattle, or chases or approaches a personal or another animal in a menacing way.
  • A violation of this section establishes proof of "prior knowledge of a dog's dangerous propensities" under section 767.13(2), Florida Statutes (2002), as may be amended.

An owner can appeal the department’s decision with a written request within 7 days of notice of intent to declare his or her dog dangers. If requested, the owner will attend a hearing
