Birth Injury

The day your child is born should be one of the happiest times of your life. The hospital, along with the doctors, nurses, and support staff is tasked with the duty of keeping the mother and child safe. When they are unable to do so, devastating effects and injuries can occur. Considering the sensitive nature of childbirth, the effects can lead to lifelong issues or even death.

The inability to perform job duties at a hospital is simply unacceptable. The years of training that go into being a medical professional means that they are held to a higher standard of care. Failure can mean the difference between life and death, so they need to be accountable for their actions.

If you or your child was injured during a birthing procedure, you have the right to file suit against the offending party. With the help of a qualified personal injury lawyer in Florida at your side, you can sit back and focus on the healing process while your legal counsel argues to prove negligence on your behalf in court.

Types of Birth Injuries

With such a complicated procedure, there are many variables involved in childbirth. This means that there are also many things that could go wrong. A complex process combined with a fragile life make this a relatively difficult medical situation. Even so, these are professionals who should know exactly how to react. Some of the most common injuries that occur during childbirth include:

  • Broken Bones / Fractures
  • Umbilical Cord Entrapment
  • Nerve Damage
  • Forceps Injuries
  • Vacuum Injuries
  • Facial Paralysis
  • Permanent Disfigurement
  • Premature Death

Damages are awarded to the plaintiff after negligence is proven. Some of the primary forms of damages include pain and suffering, mental anguish, medical bills, loss of enjoyment of life, rehabilitation, permanent disfigurement, permanent disability and many others.

Cerebral Palsy and Brachial Plexus

One of the most well-known birth injuries that occur in the United States and around the world is Cerebral Palsy. Cerebral Palsy is an injury that develops when a child's oxygen supply to the brain is lowered or reduced. Cerebral Palsy can develop if the treating obstetrician does not properly or adequately monitor the progression of labor, along with as child's vital signs, through frequent vaginal examinations and electronic fetal heart monitoring. This type of birth injury can also occur if the doctor fails to order a timely C-section after noticing that the child is improperly positioned.

Another similar type of birth injury is called "Erb's Palsy." This occurs when there is undue physical force place on the child. This can lead to paralysis, reduced muscle control and loss of sensation in the shoulders, arms or hands. Erb's Palsy generally develops during a difficult delivery when the child is stuck under the mother's pelvic bone and the doctor grips the child's head in an attempt to release him or her.

Brachial Plexus, on the other hand, is the major bundle of nerves that starts at the base of the neck and runs through the shoulder and down into the arm and hand. There are three specific injuries that can occur in this area of the body during birth:

  • Stretch - This injury refers to a simple stretching of the nerve fibers in the brachial plexus—the major bundle of nerves that starts at the base of the neck and runs through the shoulder and down into the arm and hand. A stretch injury with the sheath of the nerve intact can result in a “neurapraxia,” a short-term injury, which can have symptoms such as decreased movement or sensation
  • Avulsion - The only known cause of avulsion injuries is extreme traction (pulling) applied to the brachial plexus. This can impair the flow of the nerve impulses that are supposed to be going up and down the spinal cord without disruption. The disruption in nerve flow from an avulsion injury can cause a reduced ability to move the leg that is on the same side as the injury, and even a reduction in the growth of the leg.
  • Rupture - This injury refers to one or more nerves being stretched beyond their limits to the point where they actually tear, in whole or in part.
