Elements of a Hit and Run Collisions

Florida statute §316.027 governs hit and run collisions. Under this statute, Florida states that a driver involved in an accident resulting in injuries or death to the other driver(s) is considered a hit and run accident which is a felony under Florida law.

This statute defines a hit and run driver as a driver who leaves the collision scene after failing to await law enforcement and neglecting to provide help to the other party involved in the accident. 

If after an investigation, the injured driver cannot locate the hit and run driver, the injured party must seek damages from his or her insurance provider which may choose to accept or decline the insured’s insurance claim.
