ATV Accidents

All Terrain Vehicles are the perfect recreational vehicles for Florida. Best on beaches and trails, ATVs have provided hours and hours of entertainment for residents and visitors alike. Considering the aggressive and risky nature of these vehicles, practicing safety while driving an ATV is paramount in preventing injury.

Although acting in a responsible manner can prevent many potential dangers from arising, there is always the possibility that a mechanical defect or the careless actions of another can make this adherence to safety all for naught. A serious injury can lead to a long and difficult road that includes medical bills, loss of wages and mental anguish. All of these costs will add to the extreme pain and suffering that are the result of negligence.

If you have been hurt while on an all-terrain vehicle in Central Florida, it is important that you take the steps necessary to find a favorable resolution by aligning yourself with a qualified personal injury attorney who can effectively represent you during this complex and time-consuming legal process.

ATV Safety

ATVs can be quite dangerous if operated incorrectly. Operating it in an unsafe manner not only puts you at risk, it also endangers everyone around you, likely friends and family. Some of the most important safety tips to keep in mind when operating an ATV in Florida include:

  • Always wear a DOT-compliant helmet, goggles, long sleeves, long pants, over-the-ankle boots, and gloves.
  • Never ride on paved roads except to cross when done safely and permitted by law - another vehicle could hit you. ATVs are designed to be operated off-highway.
  • Never ride under the influence of alcohol or other drugs.
  • Never carry a passenger on a single-rider ATV, and no more than one passenger on an ATV specifically designed for two people.
  • Ride an ATV that is age appropriate.
  • Supervise riders younger than 16; about one-third of ATV-related deaths and injuries involve children.
  • Ride only on designated trails and at a safe speed.

Florida state laws specifically mention that all ATVs operated on public land must be titled, although there is not a state registration requirement. Florida law also says that riders under 16 must wear a helmet and eye protection at all times and that ATV use is prohibited on paved roads.

Causes of ATV Accidents

As a recreational motorized vehicle, an ATV requires a great amount of safety, yet drivers tend not to practice this as much as when they are driving their car. This is not always the case, but sometimes enjoying yourself can lead to safety omissions, or a person who is not well-trained on an ATV might go overboard when seeing what they can do. Some of the causes of accidents and injuries on ATVs include:

  • Reckless Driving
  • Driver inexperience
  • Ignoring safety rules or basics
  • Improper positioning on the vehicle
  • Too many riders on the vehicle
  • Lack of protective gear
  • Operating an ATV at unsafe speed
  • Operating an ATV while under the influence of drugs or alcohol

Injuries and Damages in an ATV Accident

Considering the inherent lack of protection that one has while operating an all-terrain vehicle, many different injuries can occur, including:

  • Back injuries
  • Head injuries (concussions, brain injuries, blunt force trauma)
  • Neck Injuries (whiplash)
  • Nerve Damage
  • Burns
  • Broken Bones
  • Fractures
  • Muscle tears, strains and pulls

When approaching personal injury litigation, you will be pursuing compensation through damages. Damages are the costs relating to negligence. Some of the likely damages that will be part of an ATV accident include pain and suffering, loss of wages, reduced earning potential, loss of enjoyment of life, permanent disfigurement, mental anguish, loss of companionship or consortium and rehabilitation costs.
